Latest Updates on Personal Data Protection Act 2010

Additional Classes of Data Users

 

Effective 16 December 2016, the Personal Data Protection (Class of Data Users)(Amendment) Order 2016 (“the Amendment Order”) has amended the Order and expanded the 11 classes to include:

(a) licensees under the Pawnbrokers Act 1972 [Act 81]; and

(b) licensees under the Moneylenders Act 1951 [Act 400].

Additional entities have also been added under two classes, namely Malaysia Airlines Berhad under transportation, and Pengurusan Air Selangor Sendirian Berhad for utilities.

As no transition period has been set out in the Amendment Order, the requirement to register and obtain a certificate of registration from the Commissioner now applies to the above. Failure to comply could result in a fine not exceeding RM500,000 or to imprisonment for a term not exceeding three years, or both.
